1. Acceptance of these terms

These Terms of Use (“Terms”) govern your access to and use of www.infynaxlabs.com and its pages (the “Website”), operated by Infynax Labs Private Limited (“Infynax Labs”, “we”, “us”, “our”).

By using the Website, you agree to these Terms and to our Privacy Policy. If you use the Website on behalf of an organisation, you confirm that you are authorised to accept these Terms for it. If you do not agree, please do not use the Website.

2. Information about our services

The Website describes our software engineering, AI, cloud, data, integration, enterprise platform, and talent services and our products. It is provided for general information only.

Using the Website does not create a client relationship. Any services we provide are governed by a separate written agreement, such as a master services agreement, statement of work, or order form. If that agreement conflicts with these Terms, the agreement prevails. Our products, such as Engage, have their own terms.

Proposals, estimates, timelines, and prices we share are indicative and non-binding until set out in a signed agreement.

3. Acceptable use

You agree to use the Website lawfully and not to:

• attempt to gain unauthorised access to the Website, its servers, or connected systems, or interfere with their operation;
• introduce malware or other harmful code, or carry out denial-of-service, load, or vulnerability testing without our written permission;
• scrape, harvest, or systematically extract content or data by automated means, except by standard search-engine crawlers that respect our robots.txt;
• submit false, misleading, infringing, or unlawful information, or impersonate any person or organisation;
• use the Website to send spam or unsolicited communications; or
• use the Website in breach of applicable law, including the Information Technology Act, 2000.

If you believe you have found a security vulnerability, please report it responsibly to support@infynaxlabs.com and do not access or modify data that is not yours.

4. Intellectual property

The Website and its content—including text, graphics, layouts, code, the Infynax Labs name and logo, and our product names—are owned by or licensed to Infynax Labs and are protected by intellectual property laws.

You may view and print pages for your personal or internal business reference. You may not copy, modify, republish, distribute, or create derivative works from the content for commercial purposes without our prior written permission.

Third-party marks: names and logos of technologies and platforms (for example Salesforce, ServiceNow, Microsoft, AWS, and others) are trademarks of their respective owners. They are used only to describe technologies we work with and do not imply partnership or endorsement unless we state otherwise. Stock photographs are used under their providers’ licences.

5. Enquiries and submissions

When you send us an enquiry, application, or feedback, you confirm that the information is accurate and that you have the right to share it. Please do not send confidential or sensitive information through the Website. We are not obliged to keep website submissions confidential unless we have agreed to do so in writing, for example under a non-disclosure agreement.

If you share ideas or feedback about our Website or services, we may use them without obligation to you.

6. Careers and recruitment fraud

Information about careers is not an offer of employment. Any offer is made only in writing by Infynax Labs after our recruitment process.

Beware of recruitment fraud. Infynax Labs never asks candidates to pay any fee, deposit, or charge at any stage of recruitment, and only contacts candidates from official @infynaxlabs.com email addresses, such as hr@infynaxlabs.com. If you receive a suspicious offer using our name, do not pay and report it to hr@infynaxlabs.com.

7. Accuracy of information

We aim to keep the Website accurate and up to date, but its content is general information, not professional, legal, financial, or technical advice for your specific situation. Descriptions of capabilities, industries, technologies, and examples are illustrative. We may change or remove content at any time without notice.

8. Third-party links and services

The Website links to third-party websites and uses third-party services, such as form delivery and hosting providers. We do not control and are not responsible for third-party content, products, or practices, and your use of them is subject to their terms.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Our liability for services is governed solely by the relevant client agreement.

You agree to indemnify and hold harmless Infynax Labs from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Website.

12. Suspension of access

We may suspend or restrict access to the Website, in whole or in part, at any time, including for maintenance, security, or breach of these Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory rights you have as a consumer where you live, disputes arising from these Terms or the Website are subject to the exclusive jurisdiction of the courts at Noida, Uttar Pradesh, India.

14. General

• Changes: we may update these Terms by posting a new version on this page with a new “Last updated” date. Continued use of the Website after changes means you accept them.
• Severability: if any provision is held invalid, the remaining provisions remain in effect.
• No waiver: failing to enforce a provision is not a waiver of our right to do so later.
• Assignment: we may transfer our rights and obligations under these Terms, for example in a corporate reorganisation.
